Article 1 (Purpose)

The purpose of these Terms of Service is to define the rights, obligations, and responsibilities of the Company and the User regarding the use of the "Flowtalk" service (hereinafter referred to as the "Service") provided by the Company.

Article 2 (Definitions)

  1. "Service" refers to the YouTube-based language learning application and all related services provided by the Company.
  2. "User" refers to an individual who agrees to these Terms and uses the Service.
  3. "Paid Service" refers to various online digital contents and related services provided by the Company for a fee in the form of a recurring subscription.
  4. "Curriculum" refers to the English learning program generated by AI based on the YouTube links registered by the User.

Article 3 (Effect and Modification of Terms)

  1. These Terms shall become effective upon being posted on the Service screen or notified to Users by other means.
  2. The Company may modify these Terms within the scope of relevant laws. Modified Terms will be announced 7 days prior to the effective date (30 days for changes unfavorable to the User).
  3. Users who do not agree to the modified Terms may stop using the Service and request account withdrawal. If a User does not express rejection by the effective date, they are deemed to have agreed to the modified Terms.

Article 4 (Conclusion of Contract and Provision of Service)

  1. The service contract is concluded when a User completes registration through a social login via a Google account.
  2. The Service restricts registration and use for children under the age of 14.
  3. The Company provides the following services:
    • Generation of English learning curricula based on YouTube video links.
    • Extraction, translation, and analysis of video scripts using AI.
    • Provision of daily learning programs and progress management.
  4. This Service supports curriculum generation only for YouTube videos produced in English, Japanese, Portuguese, and Korean. Please note that the video must include official Closed Captions (CC) data for AI analysis; service availability may be limited for videos without subtitles.

Article 5 (Payment and Refund for Paid Services)

  1. The Company may provide part or all of the Service as a paid service in the form of a recurring subscription.
  2. Payments for Paid Services are processed through the Google Play in-app billing system, and Users must comply with Google Play's payment policies.
  3. Subscription cancellations and refunds are processed in accordance with Google Play's refund policy. Users must request a refund directly through their purchase history in the Google Play Store. The Company does not possess the authority or an independent system to process refunds directly.

Article 6 (Suspension and Modification of Service)

  1. The Company may temporarily suspend the Service in the event of system maintenance, replacement, failure, communication loss, or force majeure events such as natural disasters.
  2. The Company may change the content, features, operational/technical matters, or fees of the Service. In such cases, notice will be provided via in-app announcements 7 days prior to the change.
  3. The Company is not responsible for Service interruptions caused by changes in third-party services, such as YouTube API policy changes or AI model provider shutdowns, and will provide immediate notice in such events.

Article 7 (Copyright and Content Usage)

  1. The copyright of the YouTube videos registered by the User belongs to the original creators. The Company only performs script processing and analysis for the User's learning purposes.
  2. The Service does not store or download YouTube videos on its servers and only utilizes the streaming interface and subtitle data through official YouTube APIs.
  3. Users must use the "Curriculum" generated through the Service solely for personal learning purposes and must not infringe upon the rights of original creators by commercially distributing or selling it to third parties.

Article 8 (User Obligations)

Users shall not engage in the following activities:

  1. Stealing another person's Google account or using the Service in a fraudulent manner.
  2. Commercially distributing or publicly posting content generated through the Service without the consent of the original creator.
  3. Interfering with the normal operation of the Service or placing excessive load on the servers.
  4. Violating relevant laws, these Terms, or public order and morals.
  5. Extracting subtitle data in bulk using technical means prohibited by the Company.

Article 9 (Account Deletion and Termination)

  1. Users may request to withdraw from the Service (delete account) at any time through the settings menu.
  2. Upon withdrawal, all data within the Service, including registered API Key information and learning progress, will be deleted immediately and cannot be recovered.
  3. Even if a User withdraws from the Service (deletes their account) or deletes the app while using a Paid Service (subscription), the recurring subscription payment through Google Play is not automatically canceled. The User must directly cancel the subscription within the Google Play Store. The Company is not responsible for any additional charges resulting from the User's failure to cancel the subscription.
  4. If a User violates the obligations of these Terms, the Company may restrict the use of the Service or terminate the contract without prior notice.

Article 10 (Limitation of Liability)

  1. Service Disclaimer: The Company shall not be held liable for any damages incurred by the User in connection with the use of services provided free of charge, unless otherwise specified by relevant laws. For Paid Services, liability will be determined in accordance with relevant laws; however, the Company shall not be held responsible for payment issues arising from system errors of payment gateways such as Google Play, absent intentional misconduct or gross negligence by the Company.
  2. Limitations of AI Results: The Company does not guarantee the accuracy, reliability, or completeness of translations, scripts, or learning content generated by AI and is not responsible for results arising from reliance on them.
  3. Third-Party Integration: The Company is not responsible for service restrictions or failures caused by changes in third-party services, such as YouTube policy changes, video deletions, or API suspensions.

Article 11 (Dispute Resolution)

  1. In the event of a dispute between the Company and the User regarding the use of the Service, both parties shall do their best to resolve it amicably.
  2. If a lawsuit is filed, it shall be governed by the laws of the Republic of Korea, and the court having jurisdiction over the location of the Company's headquarters shall be the competent court.
